LISTING AGREEMENT

I/We certify that the listing information I/We have provided on this listing is complete and accurate. It is understood and agreed that any misrepresentation by me on this listing will be sufficient cause for cancellation of any or all listings made by your company. I/We hereby agree to the following terms and conditions:

1. A 5% commission of the actual selling price will be assessed on each item sold where the invoicing and collection of the monies will be performed by your company. Payment of commission to Martin Brothers is due 10 days after date of collection of invoice payment.
2. A 10% commission of the actual selling price will be assessed on each item sold where the invoicing and collection of the monies will be performed by Martin Brothers. The actual selling price minus the commission will be remitted to the seller within 10 days after the date of collection of invoice payment.
3. The seller will be notified of any offer below the listed price and the seller may accept or reject the offer.
4. Martin Brothers will not warrant any equipment sold unless expressly stated by Martin Brothers.
5. Seller is responsible for all shipping costs; for proper packaging or crating and shipment to the buyer.
6. Martin Brothers reserves the right to exclude any specific keywords, comments, or annotations with the listing of the equipment that is listed on the listing pages.
7. Martin Brothers also reserves the right to list, modify or delete any listing.
8. Listings over 24 months will be reviewed for possible deletion at Martin Brothers discretion.
